Security Clearance Question?
Here's my situation, I am about to start a new job that requires a SECRET clearance. It's an IT related job for the military. My start date is in 22 days. My employer said it would be enough time to get an interim clearance and begin orientation. My problem is I am engaged to a Russian national that I met here in the US while she was on her third J1 student visa in 2010. I visited her twice in 2011 in Russia. This summer I petitioned for a K-1 fiance visa. The petition was approved and she was issued her visa in November and will arrive in 3 days. My question is will the situation be enough for me to be automatically declined an interim clearance on grounds of foreign influence? And if I am declined an interim clearance is there any way to appeal it without having to wait for the full investigation?

In truth, your case could go either way. It is possible that a decision could be made to withhold your interim clearance pending the results of a complete investigation. Generally I would not expect CCF to deny a clearance based solely on your marrying a Russian national...especially if she will reside in the U.S. and has followed all immigration laws. If you were getting a TS/SCI, it may be a bit dicier. The process for granting an interim requires that you have no derogatory information. Until the early 90's romantic involvement with Russian nationals was a definite no-no, but it started to loosen after that. Anna Chapman may have altered the playing field a little however. All you can do is report the contact and let the folks who make such decisions have their say. There is an appeal process that has a reasonable success rate if they should initially say no following your investigation, but you will be powerless to do anything if they deny your interim in the meantime. You cannot take action until the investigation is complete and your case has been adjudicated and an initial determination made. The process can drag out and be frustrating, but you can help you chances of success by meeting deadlines and working closely with you personnel security folks. FYI...The FBI has nothing to do with DOD Personnel Security Investigations. The Special Agent conducting the investigation is not a Law Enforcement Office and does not have police powers. Many are contractors and all work under the auspices of Defense Investigative Service who gets the packet from OPM (Office of Personnel Management). When the investigation is finished, it is turned over to yet another agency--Central Clearance Facility--where the investigative findings are reviewed and the case is adjudicated.

An interim clearance is only given if they are finished with the background and waiting for the finalization of the paperwork. So, if you get the interim, you should be fine... but being engaged to a foreigner may complicate things.
When your investigator comes for the interview, if he doesn't ask about it (and assuming you indicated it on the 86 properly) you shouldn't worry about it.

Each case is unique. Worked with people who were married to foreign nationals that were granted TS/SCI, so there shouldn't be too much to worry about for a Secret clearance. Never lie, or hide anything, it will come back and bite you.

No, they are investigating you not her. There was a Sea Bee stationed at NSGA Hanza married to a Filipina girl. He would not provide them with any information. He was only permitted to do things related to his job and some areas was restricted to him...............of course that was 1980.

It may...each situation is different and they decide what to do based on each unique situation.
If you try to hide it from them, they will find out sooner or later. And that can mean prison time if you lie to the FBI.
