Car accident no injuries now I'm being sued?
I was recently in a car accident. It has not been determined who was at fault. The police was called to the scene and the damages were so minimal that they didn't even want to write an accident report but I asked them to so they made an incident report. When the officer asked if anyone was hurt the other person tried saying she was hurt so the officer went around to her car to look at her damages again they just dismissed her and said she was probably just scared. Now about 2 weeks later I receive a letter saying that she has lawyers and she's going to sue me. The vehicle she was driving was a rental, damages were between $1,000-1,200 I know the estimates because I've taken my car to get fixed already and her damages were less than mine. About a week prior to this accident she was an accident hence the car rental. My question is can she sue me for damages and injuries? The damages were so minor and the vehicle wasn't even hers. I have insurance and I'm just nervous about the whole situation. Thank you.

Of course she can sue you. Anyone can sue anybody for anything at any time for anything. Simply turn this over to your insurance company. They will defend you and not allow the other party to take advantage of you.

But don't forget the police attended and are likely to have made some notes of the cars positions / damage at the scene at the time.

Tell your insurance company and give them all the information including that of the police.
I would think the claim would not go very far.

1st off, police do not determine fault, insurance companies do.
2nd; get on the phone and file a claim with your insurance company today;;;;;;;
IF, you are at fault, you will owe for the rental car damages, loss of use (from the rental car company) and the persons injuries.
At the scene, the other person "reported' being injured, and most likely since then has sought treatment, thus the letter from the lawyer, I guarantee you, this person has had treatment, since no lawyer goes after you just for damages, since there is no money in car damages, only injuries.
Since she was in a prior accident and in a rental, her injuries could be from the 1st accident and "aggravated them", or new injuries. But this is where YOUR insurance company adjuster will sort out the facts and determine if you owe or not, since that is their job.
IF, your company deems you are not at fault, then they will protect you and deny the other persons claim. If in fact they are suing you, you MUST call them asap, and your insurance company will provide a lawyer for FREE to you.

You sue the driver of the car, and the owner of the car. Whether or not there is insurance is irrelevant - you don't sue the insurance company, they just pay any judgements up to the policy limit. Yes, you ALWAYS sue the friend. If you sue the insurance company, you lose - because they didn't cause the accident.

The absolutely free reverse vin check sites generally provide fake information. To get real information, money will have to be paid. The free searches provide fake information so they can get your email address to send spam.
Stay away from shady reverse vin check sites, most likely you won't get any information after you make the payment. Not to mention you won't get a report and you won't get an answer if you try to call for a refund. Stick with a reputable reverse vin check site like http://www.reversevincheck.net/ that has been around since 1995.

Report this to your insurance carrier and let them straighten it out for you. Tell them all this information you put into this question. From the amount of damage, she could not have been hurt. Good luck.

Relax and remember that's what you have a good insurance policy for.
Contact your insurance and report the accident to them. Let them handle it. Hopefully you have a good insurance agent who can give you confidence.

Sure she can sue, she can sue for anything... the trick is can she win? Let your insurance company handle this for you and the outcome will be no problem for you.

SHE CAN TRY TO SUE YOU. OF COURSE WHATEVER DAMAGES SHE CAN PROVE YOU'LL BE RESPONSIBLE FOR. IF YOU HAVE INSURANCE I WOULDN'T WORRY ABOUT IT TOO MUCH LET YOUR INSURANCE COMPANY HANDLE IT.
