what should I do if my workers comp agent is not paying me 60% of my weekly wages?
I brought this to her attention and she said that my employer had not sent in my wage report. I have received a check but it is $500.00 short. So what is the base that she is using.or is it that she has to send something to me until she gets this report as to what I earned a week? can she do this and what should I do? She is only giving me 42% of my weekly wage.

The amount you are supp to receive can't be figured if your employer hasn't sent the report . Every state has a diff formula and a diff maximum amount. If you have copies of your pay stubs, them your agent can fill out the wage report. As far as what you receive, for example, when I was a work comp adjuster, the max weekly paid out in GA was $375 per week, in TN IT WAS $525 per week. If you are going to be out if work for awhile and are seriously injured, I suggest you get an attorney.

That's quite a significant amount of shortage.
Keep in mind, that 60%, is subject to a MAXIMUM amount per week. If you make $100,000 a week, you do NOT get paid $60,000.
The exact amount of maximum, varies from state to state, but it averages around $400 per week. If you're expecting a $900 a week payment - it ain't gonna happen.
