what would happen if a employer won't give you your w2 form for taxes?

I usesd to work for this non profit company here in Bar stow CA i have world with them for 5 years and this is the only year they haven't sent me my w2 form what would hap pend to this company

    The IRS directive says they have until the 31st of January to mail it. If you don't get it by Feb 15th you can call the forms hotline and request a substitute W-2 form. You can use that or your final pay stub as long as all the required information is there.

    The employer can be fined heavily. The IRS takes this seriously.

    But, hold your horses for a minute, they don't have to get you a W-2 until Jan 31st so they have another 7 days. Generally even if they are late the IRS won't do much to them.

    If you don't have your W-2 in hand by Feb 15th and you've made every reasonable attempt to contact them and get it, then you can file for a substitute W-2 if you don't mind delaying your refund by 3 or 4 months. The FASTEST way to get your refund is to wait for your W-2.

  • They have another week to get them in the mail to you. Be patient. The IRS does not consider them late until Feb 15th to allow for mail time.

    If you don't have your W-2 by Feb 15th, then you call the IRS and file a formal complaint. The IRS won't take complaints before then.
