What do I need to get a divorce when my wife is out of my state?

I want to file for a no-fault divorce. I live in Pennsylvania and she lives in Michigan. I don't want to have to get a lawyer, can't really afford it. I have lived at my current address for almost a year and we have been separated for almost 3 years now. What do I need to file on my own? Is there anything special I have to do because she is out of state?

    I've read here some people talking about going to the courthouse and get a no-fault divorce form and filling it out. My county doesn't provide that. So call your county court clerk's office and find out if they have such an animal. If not - go to the clerk's office and tell them you'd like a copy of the file on a no-fault divorce/ They'll take you to a large filing cabinet or a computer and get you started. You look through the files until you find one that's a lot like your situation. Then you tell them your wife is out of state and ask them if "this" case is enough like yours so you can copy it? They CANNOT give you legal advise - but they can tell you if what you're proposing to do meets the requirements. Ask them how much it will cost for you to file for divorce. The will also charge you 2 or 3 bucks per page copied - you copy that entire file - go home use it as a guide and draft your own - make a copy of what you've done - taking it to the clerk's office and ask them if it's complete - pay the filing fee - likely in the 75 to 100 dollar range. Part of the cost will be to forward what you've written up to Michigan so your wife receives notice - you telling them that she knows about it won't get it - she has to receive notice - you can ask them how long it will take - but they aren't going to tell you - too many people keep calling and calling and calling when the magic date they gave out comes around and it doesn't happen.

    It won't be perfect - but the best way to find out how long is to talk to someone who recently got a divorce in your county. Otherwise - go to court - sit in and when a divorce is heard - whether the final judgment comes down or not - ask one of the parties when they filed. You do the math.

    She doesn't have to agree or sign any papers - but you MUST give her notice.

    Call up your local family court, and they should be able to at least tell you what to file with them. It's not hard to do such a divorce, especially is there are no major outstanding issues to litigate, such as large property division or kids.

    You need a lawyer. If you can't afford one you may qualify for legal aide.

    If not, it shouldn't cost much but you can't afford not to do it correctly and make it legal.

    You file in your state and she will be served papers where she is.
