Tax legal isue-empoyer filess 1099 on his "employees" but pays by the hour. Claims to irs he has 1 employee?

emoyer pays by the hr to his employees. But gives everyone 1099 for taxes. he has a bogus website and lists he only has one employee. he doesnt pay taxes on his employees. no unemployment no federal, etc. all the "employees" pay thier own taxes.

is what this employer doing illegal?

    go to www.irs.gov and get the SS8 form, complete it and submit to IRS and let them determine your status,

    they will deal with the 'employer' depending on what they determine

    I work for an employer, get paid hourly and get 1099'd. I work as a home care aid indepently, and am responsible for ALL of my taxes.

    Likely yes, but there are ways for an employer to use contractors that don't violate labor law. You don't give enough facts to get a fair opinion. If you want to challenge your status you can call your state labor board and start an inquiry.
