It's a known glitch, and there a ton of things that could trigger it. One fix that has worked for many people is to go find a guard and attack him (thus making you guilty of assault). Yield to him and pay off the 40 gold fine. This might reset your "wanted" status and make the guards that are supposedly pursuing you go away.
