is someone protected by Good samaritan laws if they perform CPR on a patient in a hospital emergency room wait?

I am studying Medical law and would like some help if you could help me answer this question, my book doesnt make it really clear.

is someone protected by Good samaritan laws if they perform CPR on a patient in a hospital emergency room waiting area and the patient dies?

    Yes they are. WHERE the action is performed is irrelevant.

    Who, training, and the persons obligations to the patient are the relevant factors.

    So if you are sitting next to someone in the ER waiting room, or even if you are in the bed next to them in the ER, they crap out and you do CPR, you are protected.

    it would depend on the exact law for that state but generally if you keep up the cpr until another trained person takes over or you are so exhausted that you can no longer continue then you are protected

    from my CPR training, I would think they would be protected. however, I can imagine that the hospital may be at some legal risk for failing to get them real medical treatment in a timely manner.

  • Good samaritan laws exist in some jurisdictions, and they vary from jurisdiction to jurisdiction. That's one reason why your text cannot provide an answer. You need to study the law where YOU live.
