While providing at home care for an elderly family member?

Would it be necessary, as far as taxes are concerned, for the family member to have to employ me? Does she have to report this on her taxes? She was recently told this by an attorney and we both find it to be a bit "out there". This would mean a W2 for me and the whole 9 yards of fica, ss, etc???? Please give me details, where to find details myself, etc.

Update:

I am being paid out of pocket. Insurance pays her Dr. bills only. She needs me to take care of her. What she pays covers the cost of her items needed, a bit towards the grocery bills, and pays me as well. We want to keep her out of a nursing home. I should have stated that, sorry. I am not a nurse, I'm a niece. :-) She lives with us.

    "and pays me as well"

How much? Do you get paid by the hour? If you're talking a couple of hundred or more per week (not including the reimbursements), then you probably should do the W-2 route. If it's something like $50, I'd consider that a gift from a grateful aunt.
