Is this scenario rape or not? ?
Me and the man in question concented to sex before the drink hit me, then I went with him to his place and within a few minutes into sexual intercourse; I passed out due to being very drunk. He carried on, I know as I kept waking up and re-passing out. Bear in mind I consented before hand, a few of my friends say its possibly rape; I thought rapings are non-concential, no? Is this rape? Not rape? Other? Etc...?

The fact that you went to his place and consented before drink means it is not rape.Even if a woman is fully drunk,she will feel when the penis penetrate deep.Perhaps you were not able to resist partly due to drink and partly you wanted sex.Your sex is sex after mutual agreement and not rape.Perhaps you can say it was unethical to have sex in such a situation.

Does he know that you were passing out? If he did, then kept on going, then I think that could be considered rape. But if he didn't know or didn't realize, then I would say no. But even so, it's really no big deal. You had consented in the first place, so why does it matter now? It doesn't sound like he was being malicious.

It's a tricky area. It would have been polite of him to stop when you passed out, but you did give him consent. The major variable would be how drunk he was - if he was sober, it becomes more dubious, whereas if he was drinking as much as you he may not have been much more aware than you were.
You could probably get him convicted for rape, but I would advise against it - if you didn't mind, there seems little point in antagonising him for something that doesn't bother you, whereas if you did maybe clarify that in future you want him to stop if you aren't concious.

Intercourse with someone who is unconscious is rape. It'd be pretty hard to say "I didn't know she was passed out."
It's one thing to be drunk, cause then I'd say, lol. nope, it's not... he'd have to be pretty out of it to not know you were out, WHILE continuing to f*ck you.
