Can off-duty police collect DNA?
Are police officers able to, when off-duty, collect DNA from a crime scene as well as suspects for the use of a criminal investigation? I am asking in a scenario where off duty police hear a fracas and find a man dead. They quickly collect samples from the suspects and the crime scene itself. The scenario does not specify if they called for on-duty officers, or if they identified themselves; this isn't even the premise of the lab we did; it was about DNA fingerprinting.

A police officer may not be at work, but they are sworn law enforcement officers 24/7. Any function that they can do while working, including arrest, use of their firearm to stop a crime, or collecting of evidence, is completely legal.

Would you give some random stranger DNA samples? I mean you said from the suspects as well. If they don't ID themselves as a cop then who would let them have the sample? OK passing on that point the off-duty Cop would more then likely just hold everyone until the on-duty cops showed up. They are still authority figures and could collect the samples IF they had the right equipment, but they aren't likely to carry that with them.

A police officer, whether "on the clock" or not, is a licensed police officer 24/7/365. They are acting on behalf of the police department when investigating crimes or arresting persons, even if it is before or after their shift.
The defendant, if he has any questions about evidence against him, would be consulting his attorney.
