No. The Court concluded that the shared responsibility payment has many characteristics of a tax, and therefore should be treated as such. Specifically:
o The payment is not so high that there is really no choice but to buy health insurance
o The payment is not limited to willful violations, as "penalties" often are
o The payment is collected solely by the IRS through the normal means of taxation
Any attempt by the government to "force us to buy anything at all and call it a tax" must survive this test as a threshold matter.

According to Roberts' reasoning, yes. Theoretically, the government could levy a tax for not buying a Chevy Volt, and there would be no legal ramifications.

You are NOT forced to buy health insurance. If you don't buy health insurance there are no criminal penalties. You simply pay a higher tax rate if you don't buy health insurance.
