Why do Cons blame Obama for a "tax" increase for health care,,,?

    He determined that the Obama admin could not present it Constitutionally as protected by the Commerce Clause, but as a tax, it can stand lawfully, which I think is garbage and this "justice" should be ***** slapped for, but he's still not the guy who pushed it through Congress and threatened the states to get on board with it for fear of having their existing medical programs cut off at the knees as "punishment" they said no to it. Obama is a thug, as proven repeatedly over the years by his manner of getting others to go along with what he wants, and punishing those who don't, just as he is now trying to punish Arizona and rub salt in the wound after the SCOTUS shot down most of the state level immigration law they've been fighting for for so long now, by cutting off the 287(g) program, basically declaring war on the state and telling them that not only can he have the SCOTUS twist the Constitution to keep them from enacting state immigration laws, but he will refuse to cooperate with state law agencies as mandated by existing federal law to get even with them for trying to do so. He's a total dictator, and it's commonly referred to as "Obamacare" for a reason, so be it covered by the commerce clause, or declared a tax by a "conservative" court justice, it's still Obama's baby!

    It’s obvious that neither you nor the other conservatives have read the decision. The Legislation contains a provision that, if you do not buy insurance, you must pay money to the IRS. This amount begins at $35 in 2013, and then - in 2017 - increases to 2.5% of your AGI. The Legislation referred to this money as a “penalty”. The SCOTUS ruled that it was a tax. Here’s why. According to SCOTUS, a penalty must sufficiently penalize for not following the law, that 2.5% of your AGI is not sufficiently high to be considered a penalty and, therefore, it was considered a tax. The SCOTUS did not provide a specific threshold where a tax becomes a penalty, but it did provide an example where a company was charges 10% of its earnings, and SCOTUS (decades earlier) considered this to be a penalty, not a tax. Essentially, conservatives are complaining that the amount of money paid to the IRS is too low. As an example, if your AGI is $40,000, the Obama administration would specify the payment as $1,000 (2.5% of $40K). Under a conservative government, the amount would be $4,000 (10% of $40K). With a conservative in the White House, you may see lower taxes, and significantly higher penalties. How else will they raise money to cut taxes for the wealthy?

    I've been arguing that ever since the decision came in. The act itself had no tax in it for the mandate ... its the supreme court that made it a tax.

    @John As it was it was not a new tax. NOT as if you would understand that though.

    @xpatinasia Like most conservatives you still fail to realize it was not a tax prior to the supreme court's decision.

    Fox DID tell it like it happened. What makes you think they didn't. If Obama is going to take credit for the law he has to take blame for the mandate being a tax.
