Can I get rid of my tenant's boyfriend?

Ever since my tenant trespassed into my yard and harassed my family, she then attacks me, assaulted me, i have a restraining order against her and she is not allowed on the property (my 2 family home in which i live in the 1st floor and she is leasing the 2nd floor) until after the trial in august, Her boyfriend keeps coming to the apartment and starting to harass us, is he even allowed here? He was never on the lease, moved in after she did. do i have the right to call the police to have him leave?

    If he is not on the lease and is living there then chances are that you could have him evicted. If he is there as a guest of your tenant then there would be very little you could do. Different states have different rules. Look in the contract your tenant signed. Was there anything in it that discussed other tenants or guests? I know my contract stated something to the effect that I could be the only tenant unless I notified my landlord. I know because I remember thinking that it was absurd to think that more than one person could live in my apartment. It was so tiny that we had trouble fitting my twin bed mattress in the bedroom doorway. I suggest that if he comes near you again and harasses that you call the police to have him removed. You have a restraining order. That's what they are there for. In order to have him permanantly removed though you would probably need a court order.

    We have no idea what your lease says. Odds are it doesn't bar her from having guests though. You can do exactly the same thing you did when she harassed you get an RO.

    ABSOLUTELY YES.

    He's not on the lease. He doesn't live there legally -- therefore he has NO LEGAL GROUNDS TO BE ON YOUR PROPERTY AT ANY TIME.

    Every time you see him on your property call the cops.

    When he's arrested he'll get the message.

    Sorry, but I don't think so. Your tenant, as such, has the right to have whomever she chooses over. You cannot ban or control her guests. If he lives there, does your lease with her prohibit it?

    You can, however document his behavior toward you and seek appropriate legal actions... but as far as nixing him, I don't think you can.
