Fast food restaurant laws question?
I work at a fast food restaurant and today I got a corporate complaint.
These 2 customers came through our drive through today and ordered 2 chicken sandwiches. When I gave them their food they said that they wanted one plain and the other regular. The food was rang up 2 plain. So I asked them for one of them back so that we could fix it. (no big deal right?) So then they tell me that they want to keep both of the sandwiches and get another one (for free). I then told them that I needed the sandwich back so that we could fix the problem. Instead of taking the sandwich back and slapping on the condiments and calling it good I was going to have a fresh one made for them for better service. But I could tell that they wanted to scam me into giving them an extra sandwich that they didn't pay for. When I took the sandwich the woman in the passenger seat said to me "You know that's illegal right?" I said "what's illegal?" she tells me that it's illegal to take an item back through my window. By this point I was pissed but I did not show it and I told them I was just going to throw that one away and get a new one made for them. That pissed them off even more because they wanted to eat that sandwich but i did not care because throughout this whole thing I was as polite as I could be and they were just making it harder and harder to even deal with. Anyways I threw the sandwich away. Our policy is that if we hand out food and if it's wrong or if we hand out to the wrong customer AND THEY TOUCH IT it has to be thrown away. I was not planning on giving this sandwich to another customer seeing how they had their hands all over it.
So when I give them their NEW sandwich (which I made sure they made it with the chicken that had just come up from the fryer) the woman again says for about the 4th time that it was "illegal" and that it was a "Shitty thing for me to do" and "I should be ashamed of myself" They then left Yelling a big "F*CK YOU!"
So yes I do know that the customer is always right and blah blah blah...and I could have just let them keep it...But what I'm asking is, is it illegal to take back the food? Especially when they only payed for 2..

No, it's not illegal if you're planning on taking it back, fixing it, and giving it back to the original customer who ordered it. People today like to say that everything is illegal, but chances are she has no idea what she's talking about.

I don't know about the food from your own restaurant, but my fiance worked in fast food for years when we were in high school, and the driver cannot hand the employee a cup from their car and ask them to throw it away. His restaurant also had the rule that you have to toss it if the customer touches it (like a cup for a refill).

congrats on keeping a cool head even tho you were pissed off. that was the best thing you could've done. as far as the "legal" aspect, there's no law against correcting a customers order; in fact it's expected. although if you find yourself in that situation again (unruly customer), just let them keep it and give them another (ask your manager). there are some people out there that just want to "get one over on you" let them, and move on.

Its unlawful to carry alcohol right into a speedy meals joint. The speedy meals restaurant wouldn't can help you carry it in anyway. A restaurant can serve alcohol to its customers if it has a state liquor license.
