Can he call the ASPCA on my horses?
I rent a horse barn/farm from this dude and we haven't paid rent in a month, only because we are moving the horses to a different farm closer by soon. Yesterday he put a lock on the gate of the barn, and my mom said she had to move [the horses] soon because she was afraid he'd call the ASPCA on them or something and say they were abandon. The horses are in good condition and everything, but we didn't sign a formal lease, so he could just say we left them there...can he do that? If that were to happen, what would become of my horses? Would I be able to get them back? I haven't had a chance to talk to the guy because I lost his number...do you think he'll think we are just going to give up on the rent and go ahead and get the horses out? We're moving them next weekend, but I'm afraid he would do that in the meantime...I'm sorry for the everywhere-ness, I'm in bit of a panic.

Firstly just calm down hun, he cannot do anything if the horses are in condition. I hope you can still get to your horses, if not thats theft on his part, they are your property. I would go to the man apologise and pay the rent with the notice that you are leaving, you cant expect the man to let your horses go when you havnt paid for that months rent, if however after payment he doesnt let them go then you get intouch with the police and explain your situation. If you did not sign a agreement when you joined the yard there is nothing he can do, the ASPCA will not take the horses at all they dont like to waste time. Does all your horses have passports?! proof they are yours?! this way he can not claim the horses are his. Dont panic everything will be fine, he has no right to put a lock on the barn if your horses are in there as this is classed as stealing and the police can be involved as i have found out in previous experience.

All you need to do is pay the rent. He can hold the horses against non payment of rent.Just pay him the money that you owe him. Because you're moving is no reason to withold rent.If you can't afford the rent then you can't afford to keep horses.

You could go out and bu temporary fencing and make a small pasture in your backyard for the meentime. They shouldnt mind it for a short while, get a 10 gallon bucket and a make do hay trough, and they should be good :)

pay your rent, then you wont have to worry about your horses and wont be leaving on bad terms
