How long can someone be in jail for burglary first offense in texas?

His charge is burglary of habitation & it's his first offense.

Update:

He only touched the tv that was stolen from the house and the cop charged him. I think burglary of habitation means burglary of a residence?

The judge where he's in jail said he's getting probation but he's awaiting to be extradited back to Texas. So idk if it will be different once he's back here. But his mom has paper work stating he's incompetent the cop knows he's slow but they won't let him go til they have his medical records which is what his mom told me.

Howard- its from psychiatric tests. It's his first offense they can't do more than yr. his brother stole from the house he got probation but he's a minor.

Social security are aware he's incompetent because he receives ssi. His mind is like a 4 yr old. He doesn't understand the things that are going on around him. U can talk to him and he will be like in his own little world which is a symptom of autism so I told his mom he need to be rediagnosed.

    First offence , they might offer probation (2-4 yrs). Depends on the specifics of the case.

    The maximum sentence is 20 years, minimum is probation. If he is incompetent it doesn't mean he goes free, It usually means he gets sentenced to some type of treatment or confinement in a mental hospital. Also, a court appointed psychiatrist determines competence. Any paper work his mother has might be worthless.
