How do i go about getting my husbands papers fixed?

So i am a U.S. Citizen and a year ago i married my husband and would like to know how do i go about getting his papers fixed...He was brought to the US as a minor and has been here since.. I couldn't imagine being without my husband he is all I have and I love him and would like to know if it is possible to get his papers fixed and for him to stay in the US.. How much would it cost and how long would the process be?

    If a US citizen gets married to a foreigner inside the United States, they apply for Adjustment of Status (AoS). However, if your husband entered the United States without inspection (EWI), basically under the radar, without a visa and entry stamp and I-94 in his passport, then he is not eligible for AoS because he has no status he could adjust FROM.

    You can file an I-130 petition for him with the USCIS, but eventually he will have to attend the interview at the US consulate in his home country. If that's Mexico, then the interview would be in Ciudad Juarez. The moment he leaves the U.S., he will trigger the 10-year bar for unlawful presence over 1 year and that why they will deny him the visa until he has lived outside the U.S. for these 10 years.

    You would have to live with him in his country for these 10 years, because if you don't stand by your man, for richer for poor, for better for worse, as you pledged when marrying him, the U.S consulate will even 10 years from now conclude that your marriage is not bona fide but was only entered into in order to provide your husband with immigration benefits to the United States, and they would call this fraud and bar him for life.

    So accept the fact that you will continue to be married to an illegal immigrant who has no chance of a normal life in the United States, or that you two will need to live in his country for 10 years. If it's Mexico, look into Merida, the capitol of Yucantan. It's a beautiful town, super charming, or stay within Baja California. I'll be in Cabo San Lucas in a few weeks, and I could imagine living there too for a certain amount of years.

    He has no papers to fix! He cannot get legal status as long as present in U.S. Marriage and children will not give an illegal alien legal status. You knew the consequences going in. do not fool yourself, sooner or later he will be caught and deported. You must chose whether to go with him or not because he will be banned for up to ten years.
