It depends on what degree of retardation you're talking about. If they are severely retarded, they more than likely will be exempt from any punishment. With that said, the person that oversees them may be forced to take some responsibility to some degree, and may even lose the rights to the mentally retarded person. Hope this helps! :)

Mental retardation may be used in mitigation in a plea of guilty. Learning difficulties may result in reduction in tariff of sentence however it does not absolve the convicted or accused of criminal responsibility.
