Can a landlord kick you out if you refuse to sign a another one year lease in CA?

We've been in a leased home for 2 years. The landlady's son is now taking over the rental & wants us to sign another years lease. We want to go on a month by month basis so we can look for a house to buy (which will probably take 3 months).

He says he's going to evict us. Can he do that?

We have never made a late payment or asked them to fix anything in this old house.

Update:

Ryan. We paid the rent for next month already & out of respect for his mother (a widow), we've done all the repairs & paid for them, for the last 2 years. It's an old house so there always seem to be something going wrong, mostly the plumbing.

Apparently this guy doesn't have the same respect for his mother as we do. I know she wants us to stay.

    As soon as your current lease expires, he can give you a notice to terminate tenancy and you will have 30 days in which to move, if you choose not to sign a new lease.

    Sounds like new landlord is a major problem. Call his Mom and ask if there is a way to work this out without anyone getting hurt.

    definite! purely via fact the in no way pronounced something some new lease in the past featuring one would not propose something. each landlord has each nicely suited to require a clean lease be signed ANY time a tenant would not have a contemporary lease. you're turning out to be in no way had a lease. lived month to month for some years & they nevertheless have the nicely suited to require a lease at any time. What the different tenant has or would not have has no longer something to do with you. it is completely criminal to enable one tenant proceed to exist a month to month yet require yet another to sign a lease. i'm no longer asserting it is good besides the undeniable fact that it is criminal. you may sign the hot lease or circulate out. You get no decision in the priority.

    Why would you feel you are entitled to live somewhere where you have no lease and the landlord requires one?? Do you think you should live there only as long as you feel entitled to live there? It's not your property and you don't get to make the rules. Without a lease, you are a month to month tenant and you can be asked to leave at any point with 30 days notice.

    if your lease is valid and active.

    Landlords son is full of bovine manure.

    if your lease is complete, u can go month 2 month

    for a limited time. so time to start packing , finding a

    storage place as 'long term motel' many be in your

    future.

    eviction does take a long time and he may not have

    a leg to stand on.

    google your laws in your areas.

    He is the landlord and if he wants you to sign a yearly lease, then you must sign it or move

    As longs as your in your lease, i don't think he can just evict you. Once your lease is up, they can do whatever they want with the property since they own it.

    You may have to put out another $10 a month for month-to-month.

    He can't evict you if you've done nothing wrong, but he can certainly give you 30 days notice if you are month-to-month.
