Got in an accident?!?!?!!?!?!?!?
A couple of days ago I pulled out and a lady t-boned me. She didn't have insurance so shouldn't it be 100% her fault no matter what happened. I do have insurance. BTW this is in Minnesota. The cop gave me a ticket. And I was thinking of taking it to court.

If Minnesota has laws that automatically fault someone who doesn't have insurance, it seems like the cop would have known that (but not necessarily).
I would contact your local police department (non-emergency number of course) and ask them whether or not this is the case.
If they blow you off, then contact some lawyers - most will do free consultation, and will tell you if you have a case.

Since you pulled out, sounds like she had the right of way, thus you getting a ticket. Most likely YOUR insurance company will pay for her damages. The fact she has no insurance, does not relieve you of fault, only that "technically" she was not legal to drive w/out insurance. The only thing the judge "Might" do, is give her a ticket for no insurance, you will owe for your ticket and then ,,,,will most likely tell you that you owe for her damages due to this accident.
It sucks, but this is how it will play out.

Um no. Her having insurance has nothing to do with who is at fault for the accident when it comes to who is liable for paying for the damages. If the cop gave you a ticket that means YOU were at fault for the accident and you and your insurance are liable for all damages. The fact that she doesn't have insurance might get her cited for that, but it has no bearing on your end.
If you're at fault, the damage to her car is fixed by your insurance anyway, so why would her not having insurance suddenly make you magically not at fault? Are you saying that if I need my car fixed, I should just find someone without insurance and ram into them head-on?

Taking WHAT to Court? The ticket says you violated the law. It doesn't matter if she has insurance or not, you STILL broke the law according to the ticket. You could fight that, but don't go in front of the Judge with the excuse that she didn't have insurance. The Judge is only interested in what YOU did or didn't do.

What does your insurance company say? look at your local DMV's website and see what it says with no-fault and uninsured motorists. Laws vary from state to state. If you are still unsure, I'd contact an lawyer who handles accidents.
