Potential Internet Fraud, what can be done?
I ordered a product from an online company six months ago and they assured me that the product would be ready within two-three months max. However, after five months of not hearing any updates and the "CEO" of the company constantly evading my questions of how much longer and even deliberately ignoring my e-mails all together, I decided to cancel the order and just be done with the whole ordeal.
About 1/3 of my original purchase was sent back but they are still keeping quite a bit of money because they "need to sell the product that I ordered" before I get the full refund. Which means I might as well be sitting in limbo until they decide to actually send my money back.
Given that I have paid them yet received no services or products (and am not expecting to anymore), is it legal for them to simply keep my money like this and if not, what can be done about it?
Also, if anyone knows at what point it goes from just a really really slow company and to actually becoming fraud, let me know? Thanks in advance.
The original amount was $3,000. I've gotten a third of it back so far but wasn't wanting to raise any alarms until I was sure there was a problem.
Given that the product was 2-3 months before it would be finished, I wanted to make sure it wasn't just a case of them being slow to produce it.
Sadly it was a full price purchase. I didn't think anything of it as I have spent similar amounts buying computer parts online before and never had any problems. This is the first time this issue has even come up, sadly.
And it was a "custom" order but all orders from the company are "custom" in that they can all have various attributes you select when you order.

It is unlikely you'll be able to recover any money. That's the huge disadvantage to internet purchasing. There's an online Better Business Bureau (BBB) which you can make a report to, and if you feel defrauded you can report to the FBI as well. If they have any sites where you can provide reviews - like online yellow pages or Yahoo local, sites like that - then you should do that, review the company and tell others about it - if you google their name you'll likely find some reviews already out there and places where you can review them. At this point, I would not expect much, that's double the time they promised and in business that usually only happens with custom furniture and orders like that - often a custom order can take longer than expected and these days business aren't backstocking supplies as they once did. If they could have at least given you a viable explanation I think it would have made more sense for them to do that.
If you used a credit card for the transaction, you should report it to your bank or lender. A business does have a right to keep some money if the item was a special order, some places charge a restocking fee, others a cancellation fee.

edit: Was that full payment for an order or was that just a deposit? That's quite a pricey item to order online, I would have been very leery. If you paid in full for your order that may have been the first sign of something wrong - rarely do custom orders get paid in full, it's usually a 50% deposit, that covers the business for supplies in the event the order is cancelled, and it protects the buyer in the event the business can't fulfill the order. Sorry, but this doesn't sound good at all. You may not recover your full payment.

First you would have to get someone to even take you seriously after waiting 6 months to make a stink. Second how much money are we talking here? Third sure you could sue for fraud but agains how much money are we talking and do not expect a police dept to take a 50 dollar case seriously.
