  • Would my case hold up in a small claims court?

Back in March I ordered a custom product from an online website by getting into direct contact with the sales team for the company. Their website promoted that there would be a ten week period between ordering and shipping while the contact from the company specifically told me that it would likely be even less (he quoted me eight weeks instead).

After paying the $4,600 I've been in constant contact with them regarding the status of the product, though I've only received vague "we're running behind" and "soon" answers. I've also learned that others were having issues with them not delivering products as far back as January, well before I was told "eight weeks" by the representative.

Now I've tried asking them to cancel the order for failing to deliver and have been met only with silence.

With a letter of demand, would a small claims court be likely to rule in my favor for the company failing to provide the goods that they said they would? Or would their claims of "it's just been delayed" get them off the hook?

  • Small Claims Court filing question?

If someone has broken a contract for sending me payments and lives in a different state than me, which state/county would a small claims court filing need to take place?

Would I have to go file it in their court or could I do it in my home state?

  • How to get money back that someone owes me?

Currently I'm in a situation where someone owes me a little under $1,000 USD and has signed a contract saying that they will send me payments of $250 by the 15th of every month until the full payment is met.

However, this month I have received no payment despite them still owing the $1,000 and am wondering what actions are possible should the need arise for legal action.

I've contacted them in an attempt to get a response for the late/missing payment but have yet to hear back and want to see what other options may be available. As of right now both of us live in the United States, though we do live in different states. I have heard that Small Claims Courts are the way to go for this to get my money back but I've also heard that Collection Agencies are much cheaper and just as effective.

What would likely be the best method should I have to rely on these methods to get my money back and would it be worth it? (Ex: Having to pay $1,100 in court fees to get back $1,000 would not be worth it.)

  • Potential Internet Fraud, what can be done?

I ordered a product from an online company six months ago and they assured me that the product would be ready within two-three months max. However, after five months of not hearing any updates and the "CEO" of the company constantly evading my questions of how much longer and even deliberately ignoring my e-mails all together, I decided to cancel the order and just be done with the whole ordeal.

About 1/3 of my original purchase was sent back but they are still keeping quite a bit of money because they "need to sell the product that I ordered" before I get the full refund. Which means I might as well be sitting in limbo until they decide to actually send my money back.

Given that I have paid them yet received no services or products (and am not expecting to anymore), is it legal for them to simply keep my money like this and if not, what can be done about it?

Also, if anyone knows at what point it goes from just a really really slow company and to actually becoming fraud, let me know? Thanks in advance.

  • Spiritually Speaking: Should we replace the steel in skyscrapers for mud bricks?

Since the Tower of Babel supposedly was enough to get even God himself worked up to the point of intervening and ruining all that work the people put into trying to get closer to him, then mud brick must be one amazing construction material.

If I accidentally drop a babby down the stairs does the five seconds of the "five second rule" start when it hits the first step or when it finally settles at the bottom?

  • Where do you think "god" will live next?

First the gods were on the mountain tops (ex: Mount Olympus) or in the sea. Then, when we explored there and found nothing, they moved into the clouds.

After we explored our atmosphere, they moved from the clouds out into space.

Now that we're exploring space, they've moved "outside time and space" (whatever that means).

Do you think they'll move again or is this the final resting place?

  • Creationists: I require your expertise and unmatched deductive skills?

Since you are all literary and scientific scholars as well as super geniuses, I simply wanted to get your feedback on the great novel:

    "Everybody Poops"

What are your thoughts on this high level book and do you think that it is scientifically accurate? Thanks for your help, I certainly couldn't figure it out on my own.

    Bonus: Explain tides.

  • Christians: How is your god both all merciful and all just?

Not all of you make the claim that your deity matches those attributes, but a lot of you do.

Justice: The administering of deserved punishment or reward.

Mercy: The discretionary power of a judge to pardon someone or to mitigate punishment, especially to send to prison rather than invoke the death penalty.

So, how can any one entity be both of these things given that they are contradictory to one another? Either your deity deals out reward and punishment in a completely just manner or he is merciful and will not deal out punishment as deserved but will "go light" on those who "deserve punishment".

    Which is it?

  • Spiritually Speaking: My mechanic is a heathen?

My car was acting up so I decided to take it to a mechanic the other day but, to my amazement, he started talking about COMBUSTION (that evil theory that was made up by the pixie lord) and he claims that it is how cars run!

Everyone knows that fairies power the engine of a car, I even have a book written by the fairies just for me that tells me that cars run on fairy power.

Yet that evil mechanic still insists that engines run on COMBUSTION! He even tried taking apart an engine to show me but I think it was just a ploy to confuse me with complicated topics.

How can this mechanic be that arrogant to think that he knows engines better than the fairies themselves?

Has anyone else had problems like this?

  • How do you explain all the infallible prophesies in the Bible?

    For example:

Isaiah 19:18 In that day shall five cities in the land of Egypt speak the language of Canaan, and swear to the LORD of hosts; one shall be called, The city of destruction.

Even though the Canaanite language was never spoken in Egypt and is now a dead language, I'm sure that this prophesy was fulfilled if you interpret it right!

    Another one could be:

Isaiah 17:1 The burden of Damascus. Behold, Damascus is taken away from being a city, and it shall be a ruinous heap.

Even though Damascus is still standing today with millions of people living in it, I'm sure this prophesy will come to pass some day!

    You can't explain that.

So, atheists, how do you explain all of these?

  • Since David Copperfield actually walked through the Great Wall of China...?

I think this would qualify for a miracle (not to mention is much better than simply walking on water) and thus must prove that he is the son of the all powerful creator of the universe by religious logic.

Who wants to donate to the church of Copperfieldism?

Newton's first law of relativity states that chaos can only increase. Therefore the Big Bang is false.

  • Why doesn't the Bible have vampires in it?

It has unicorns, witches, dragons, zombies, angels, demons, cud-chewing rabbits, and sea serpents.

Why did it exclude vampires? (Not including references to any priests.)

  • Creationists: "When science/reality contradicts the Bible, science/reality must be wrong?"?

I've heard many of you say that but I was curious, why do you prefer to put more faith in the writings of men than the "works of God".

If your god does exist, then surely he made the reality we live in. However, even you guys admit that the Bible was written down by humans (though inspired by God, it was still written by fallible humans). So why do you insist that you dismiss the works of your own god in favor of the writings of men?

Wouldn't that be an insult to your deity?

  • Spiritually Speaking: If circumcision is to "prevent disease"...?

Then shouldn't we be removing a things like tonsils, the appendix, a kidney, etc? All of these body parts are just as likely to get disease as any other so if we remove one, why stop there?

We should also cut off female breasts to prevent breast cancer.

Feel free to correct me on any differences between those and any other mutilation done to children on a daily basis in most countries.

  • Question to those who claim that evil exists in the world because of human free will?

If evil exists in this world because God could not create a world where free will exists but no evil happens, then how exactly does your heaven work?

Do you just lose your free will when you go to heaven and become a mindless worship bot (well, you're already half way there but you get my meaning). Or does your heaven have suffering too?

  • Spiritually Pondering: How many Christians realize that the most commonly stated Ten Commandments...?

...are never called the Ten Commandments in the Bible nor were they the set of rules given to Moses on stone tablets?

In fact, the following is a list of the actual Ten Commandments, as called by the Bible and as written on the second set of stone tablets (according to the Bible of course):

    1. For thou shalt worship no other god: for the LORD, whose name is Jealous, is a jealous God:

    2. Thou shalt make thee no molten gods.

    3. The feast of unleavened bread shalt thou keep.

    4. All that openeth the matrix is mine; and every firstling among thy cattle, whether ox or sheep, that is male.

    5. Six days thou shalt work, but on the seventh day thou shalt rest: in earing time and in harvest thou shalt rest.

    6. And thou shalt observe the feast of weeks, of the firstfruits of wheat harvest, and the feast of ingathering at the year's end.

    7. Thrice in the year shall all your menchildren appear before the LORD God, the God of Israel.

    8. Thou shalt not offer the blood of my sacrifice with leaven; neither shall the feast of the Passover be left until the morning.

    9. The first of the firstfruits of thy land thou shalt bring unto the house of the LORD thy God.

    10. Thou shalt not seethe a kid in his mother's milk.
