How can i defend my minor child in shop lifting arrest?
My 15 yr old son was one of five children who were caught shop lifting. The other four were let go free and clear. Three girls walked away from police staion within minutes of the arresting officer knowing one of them. The other boy was never summons to court. Story goes they went into package store to use the restroom( proven) two boys picked up alchol off shelf and placed it in a back pack, clerk then took bag and had kids proceed to front office awaitng police ride. Charges are shop lifting by consealing, and liquor possess under 21. They were heading to a beach close by at public recreation
center , girls need to use rest room , and every one with out thinking started handling liquor. And got carried away. He has never been in trouble before. We just went thru divorce his mom was mentally ill causing him stress. Whats the best way to out of this mess, plead mercy, guilty, or ask for court appoited lawyer? Im broke. We have corrective action in progress, grounded, comunity service volunteering 6 hrs, he show remorse and is a good kid at hart.

Let him go through the whole process. If he gets scared off by his first offense, hopefully it will be his last. If he learns to rely on you to help him, it could get worse. I understand what you are saying, but it's not like they are going to lock him up for shoplifting if he is otherwise a good kid.

Do they have him on video? Who was carrying the bag? Who picked up the stolen merchandise? I don't see how he can get in trouble and not the other kids, so long as they were equally involved. If there is no proof that he himself actively participated in the theft, then that would help. If not, he is still a minor and usually minors are offered alternatives to a permanent mark on their record. When I was 14, I was in a store with my friend who was shoplifting. I wasn't shoplifting, but I didn't tell on her, nor did I stop her. They had us on video and had proof that I didn't take anything, but I was with someone who did. They banned me from the store for 1 year and made me write an essay, and that was it. They didn't put anything on my record. It's probably also important what the total cost of the merchandise taken was. In the case with my friend, the total was pretty high, several hundred, I believe. The lower the total cost, the better, I would think. All you can do is go to court and be honest, but not too honest. If they don't have proof of something, don't provide extra information. Have him admit to what they have proof of. Dress well, be polite, and a decent judge probably isn't going to be too hard on a minor. Especially with a good parent who has already come up with disciplinary action.
