Purchasing a handgun in Delaware?

I think to purchase a handgun in Delaware they do a criminal background check. Can you purchase a handgun in Delaware with prior misdemeanor marijuana charges from 10+ years ago? Any information would be appreciated

    The most pertinent question of the ATF form 4473 is one about drug use. If you do not use illegal substances at the current stage of your life, then you can truthfully say NO on that question. That charge will probably not disqualify you. You may get denied, then you'll just walk out of the store. If you lie on the form, you could face serious charges and jail time. Just be honest when you fill out the form, and if you aren't sure how to answer any questions, ask the employees at the store before continuing. They aren't there to trick you and should be knowledgeable on the subject.

    "Handgun purchasers must be 21 years old.

    Prior to purchasing a firearm from a licensed dealer, a criminal history record check is required. Purchases of shotguns and antique firearms (or replicas of antiques) are exempted from the background check requirement, as are purchases by holders of valid concealed carry permits."

    As to any misdemeanor charges, I don't know. No Federal involved.

  • Go to www.nraila.org to get information abouot the state's gun laws. In theory, only felony convictions are supposed to be disqualifying.
