what can be done in this situation?

Me and my ex live in NYC, we have a 6 year old daughter, she has physical custody and we have joint legal custody, i get every other weekend with my daughter, the mother is going to DR in a couple of weeks basically leaving with her grandparents,but I'm willing to take care of my daughter until she comes back, so if i asked her and says no for no reason? can i go back to court?? this like her second time leaving my daughter and going to DR cuz she has a boyfreind over there...

i don;t work so yea i could get her everyday i don;t live far,i try to speak to the mother about it her grandparents work too

    I'm sure you could, since you have joint custody. I'm surprised a parenting plan wasn't written up. My boyfriends ex and he were very specific - down to the holidays, birthdays, vacations etc. If you don't have one yet, you should think about getting one written up. If you do have one, perhaps you should think about adding a section in there for this type of situation.

    Hope you don't have to go through court and she just says yes. Getting along/cooperating will be the best thing for your daughter.

    What's in the best interest for your daughter? Are the grandparents retired so that their time can be given to their granddaughter? Do you work and if so how will your daughter be taken care of when she gets out of school for a few hours when you're working? You seem like a responsible and a good father, work with the grandparents and see if you can pick her up everyday after your work and have dinner with your daughter and maybe even take her to school in the morning. Work with the situation in your daughter's best interest in heart.

    Of course you can go to ocurt - but you'll need to ask your lawyer about the chances of succeeding. DR - Drug Rehab?
