Marijuana possession question?
If a friend was pulled over in CT for her window tints being too dark, and I was the passenger in the vehicle, is it legal for the police to search me? They found a small amount of marijuana which is decriminalized in CT for which I got a possession ticket in CT. It is considered a civil penalty, not a misdemeanor like other states. However, I am licensed in PA and that state suspended my driver's license. Number one, is it legal for them to search me, and number 2, is it legal for my license to be suspended in PA for something that doesn't carry that penalty in CT?

Its legal for them to search you if you let them. I don't believe your friend had to let them search the car without a warrent. They may legally pat you down to check for weapons, but they can't search you without probable cause. If you smelled like weed or looked high, they can use that but you can't fight it in court unless you didn't consent to the search. For the tints, they should've just gave the driver a ticket, but cops like to try and find more so they can fill their quota. As far as your license goes, if they suspended it, chances are they can, and did.

If you consented to it then yes. If you said no they still might be able to because of reasonable suspicion. If not they can easily detain you and get a warrant to search your persons and vehicle. In addition, if cops have reason to believe there is drugs in the car they can legally search "arms length away" without consent. This means they can look in the glove compartment, in the seats what not. They cannot search your trunk without your permission.
