Was this an illegal move in traffic?

So I'm in DE and I was traveling along a big road, rt7 3 lanes. lots of traffic. it was a main road. Anyway, so I'm driving along and a school bus ahead of me stops on the shoulder and issues the blinking stop sign and lets off the kids for that stop. Despite the sign being out I drove past the bus in the lane to the left of it, was that illegal?

I know for a fact that passing a school bus on a smaller two lane road is illegal. But what if you are on a bigger road?
