Can someone be convicted of Statutory Rape under these circumstances?
Alright, this was brought up in Sexual Education. A 18 year old in Tennessee has sex with a 15 year old, and a child is born from them. If the child is born, can anyone press any types of statutory rape charges? This is for the state of TN.
We are aware that if it's within 4 years of age, it's not likely to be pressed. But this does beg the question that if the kid is born, COULD charges be filed?

It is legal but that doesn't mean the 18 year old man is off the hook. Parents are allowed to get a restraining order to keep any adult away from their minor child if in the opinion of the parents, that adult is interfering with their parental rights (including supervision, discipline, and control over said minor child). And since he has knocked up their darling daughter leaving them to bear the financial burden of the pregnancy, child birth, and raising the baby, they most certainly will arrange for such a restraining order so he doesn't get her pregnant multiple times. And if the adult man violates that restraining order, he will go to jail.
The adult is probably off-the-hook for statutory rape...but he will be paying child support for the next 18 years, and in many states, he will be forced to help pay for the cost of the birth of the child, plus with any medical bills the minor child may incur. And, of course, he won't be allowed to be at the birth of his child and he won't be allowed near his little girlfriend until she turns 18. Good luck and God bless.

Addendum: Many people think that restraining orders can only be granted in case of violence but when it applies to minors, that is not true.

The age of consent in TN is 18, but 13-17 can engage in sex with someone less than 4 years older without it being statutory rape. 18 is less than 4 years older than 15.

I am not an Atty., I have just lived long enough to have much experience.
As a mother and grandma, I would not file Statutory Rape charges when there is a child involved, if you do not take on your responsibilities, I suppose they could charge you with abandonment.
You really do not give enough information as in, I imagine the mother of this child has much to say in this situation is she being given a say as to what is happening here? What type of parents does she have like, forgiving, compassionate, easy to get along with?

It relies upon the place you reside. In Canada, the age of consent replaced into raised to sixteen. That being pronounced, there is an exemption with youthful human beings if the two human beings are interior 5 years of one yet another (a 14 year old can sleep with a 17 year old).
