Got in a car accident, now other party claiming injuries.?

Earlier today i was leaving school and driving home on a busy street. There was an object (a box full of stuff) in the middle of the road in my lane and i could not see it seeing as there where 2 or 3 cars in front of me, they start slowing down and eventually come to a complete stop to try and switch lanes and get out of the way, in the mean time i was behind them unknowing that they planned on stopping completely, they had stopped abruptly and i didn't have enough time to stop completely and i hit the rear bumper of the car in front of me (making it my fault). She immediately starts freaking out and i go to pull over to the side of the road (we were on the middle lane) and shes frantic and yelling at me , while i simply told her to pull over (so we wouldnt be in the middle of a busy street) and after i told her about 5 or 6 times to pull over she finally listened to me. At this time i got out of the car and inspected the damage my car (a 1999 jeep) was no different what so ever her rear bumper was sagging about 2 inches on the left side and had a dent. Police came wrote a simple report and told us to call our insurance providers when we got home, which i did. About half an hour after i talked to my insurance provider i get a call from my claim representative to get my statement and she then tells me the young lady in the other car was claiming she got injured. This is getting me really mad because it was a tiny low speed accident, our cars hardly moved, and shes just trying to get money from me. Im an 18 year old college student who's had to work for practically everything i own, including my car, and i can possibly afford any extremely expensive medical bills. I only have $25,000 for injury liability and my insurance provider (Geico) said they will cover something like 20% of the medical bills leaving me to wonder if im expected to pay the rest. I am stressing out a lot over this , is there any thing i can do ??

Sorry to hear that,, this is why here we have a mandatory 1million $ liability, most put 3mil.

If your insurance only covered 20% then yes you cover the rest. Sorry but yes it will be considered your fault since you hit her and the argument will be if you had the legal 3-5second spacing required depending on speed of traffic then you wouldn't have hit them. They will argue should should have had time to stop. Talk to a lawyer, sometimes they offer free consultations. My friend recently had that happened and the person falsely claimed injuries (maybe you can prove her lying?) but he was considered at fault for a medical condition he didn't know he had or never had symptoms until one day behind the wheel..that's like having your first stroke at the wheel. Good luck drive safe.

There's no need for you to rush out to get a lawyer. Your insurance company has attorneys that are on their staff and that's all they do is represent the clients. In the only case like this I've ever been involved in, my husband had an accident much like the one you describe. She sued for her injuries and go figure ... her injury claim came in right under the limit!

  • Yea cute little lizard telling you how much money your going to save, so how's that working out for you? cheap is what cheap gets, sorry to here your a broke student, but the fact remains you were involved in an at fault injury accident, you need to look at the fine print in your policy again, why there only paying 20% on $25.000 is beond me, but its my guess its how they can afford those cute little commercials and get rich,

She'll have to prove her injuries but if she claims whiplash or back problems it'll be impossible for you to contest it.
