harassed by Tesco security guard?

hi i am constantly harassed by one particular security guard in Tesco , he searched me in the middle of the shop and followed me about the shop this has gone on for some time for approximately one year he follows me about the shop and stands at the end of the till and stares at me i have complained several times and nothing has happened, he has no sia card does he need one to search me and can you give me anymore help in dealing with this problem

also i have never shop lifted anything in my life the reason i think is that i used to work there and i seen this security guard (who is only an employee of Tesco not a full time guard) working in the petrol station and doing something he shouldn't i complained and he got moved in store ever since

also i cant not go to another stores i am unable to go to any other store as my next nearest on is 5 miles away

    If the guard is an actual employee of Tesco, he is not required to have a SIA card. If the guard is an employee of a private security company, then he is required by law to have a SIA card. He cannot physically detain or search you. If he is detaining you, ask him very clearly if he is detaining you and ordering a search. Record it if you can (discreet voice recording is okay). It is not illegal to record him without his knowledge since even though the store is private property, it is open to the public. Contact the police non-emergency number and report that a security guard is hassling you, and request a police officer. The police officer will educate the security guard of when he is allowed to search. As far as the SIA card, if the guard is in fact a contracted guard and not an employee of Tesco, then you should contact the state and make a complaint. The state will have a department of regulation and licensing, or a name similar to that. They are the department that licenses doctors, veterinarians, social workers, teachers, or whatever in your state. File a complaint with them. If the guard is required to have a SIA card and doesn't, he will not be allowed to work there, will have a letter put in his file with the state, and the company that employs him will receive a fine for allowing a guard to work without a SIA card.

    Have you given the security guard and/or staff reason to suspect you of shop lifting?

    However regarding of asking this question, the security guard is harassing you unnecessarily.

    I personally would write a letter of complaint to the manager at Tesco, I'd also write a letter of complaint to the company in which the security guard works for.

    Then I'd visit my local police and make an official complaint of harassment against this man.

    To work as a security guard he MUST have a SIA licence. Tesco uses a big company for their security so you could try the head office of that company, or you could boycott Tesco and shop somewhere else if it is possible.

    In the UK security guards have no more rights than any other civilian. They can detain you if they have good suspicion that the store's goods are being removed without being paid for (which would be the alarm going off), but they cannot insist on searching you. If you refused to co-operate, they would detain you until the arrival of the police, who CAN search you. Detaining includes the use of "reasonable force" to do so. By the way, there's no typical shoplifter. They come in all shapes, ages and sizes. As an example, I'm aware of one mature, respectable lady in a wheelchair who was caught with a joint of meat under her blanket, and she admitted she'd being doing it for months. Does sound though as if you have a wierdo who is trying to justify his existence.

    If you have been stopped, and forced to be searched, and nothing was found on you, you could sue this individual for harassment and defamation of character. A simple court citation could be issued to him, by an appointee. From here, just set up an appointment to seek a lawyer's advice. But do it now! I would suggest you try to access any tapes that show you being stopped, searched etc. to present as evidence in a court of session. It would be an idea to write the date/time this happened, as it will help in accessing any CCTV recoding. As clearly, you are being victimised, and your integrity as an innocent citizen has been compromised, publicly and repeatedly. Remember though, the action will be carried out against his employer, he will be solely held accountable, as he likely isn't acting within the correct boundaries of his employment. Where it is not illegal for him to watch you, to stop you, without witnessing any breech of the law / attempted shoplifting then becomes actionable. Good luck to you.

    No matter WHO it is OR what their job is they are NOT allowed to search you under ANY circumstances (and it dont matter if he has a sia card or not)

    and they are NOT allowed to force you to do ANYTHING

    The ONLY thing they can do is carry out a citizens arrest. But the ONLY thing this allows them to do is prevent you from leaving until police arrive (who they MUST call immediately). it STILL does NOT give any right to search you

    (and even if police arrive you can STILL refuse to be searched until you get to the police station)

    If it happens again - just refuse point blank to do anything but carry on with your shopping and create a HUGE fuss in the store

    ANY attempt by them to search or detain you would then be assault - and you will have the whole shop as witnesses to it.
