Can I put a lien ona government building for non-payment?

I have put leins on residential and commercial buildings before but until now I have never had difficulty getting paid for a government building. The job is done and it has been approved. I have also waited for the appropriate waiting period.

Governments enjoy the protection of sovereign immunity, which basically means the government can only be sued when it agrees to be sued. In most jurisdictions, there is also a significant amount of case law to the effect that a lien on government property is invalid. You should consult with a reputable attorney in your area.

In theory, a lien is nothing more than a reservation of a right you already have, and you would follow up with the required lawsuit to liquidate the property and seize your payment to satisfy the lien.

As @Lori mentions, this is complicated by sovereign immunity, but if you can't even sue for non-payment, why would anyone agree to work for the government without being paid up front?

As far as I know, anyone can put a lien on anyone. I worked for a heating and cooling company and we put liens on homes all the time for work performed and no payment. Go for it and good luck :)

nice try -- I suggest the executive office building [or similar].

not that i think any Judge will approve the lien, but the newspapers will eat it up. and who knows, the embarrassment might just get you paid.

Source(s): grampa -- except in Illinois, of course -- they're broke.
