In New York state if a girl is married and hasnt?
lived with her husband for years and is pregnant does she have to give the baby the husband last name or can she give baby the fathers last name that she plans to marry once the husband will give her a divorce?

Don't know the laws of NY but if the about to be divorced husband isn't around, I assume the mother can put any name she wants on the birth certificate.

You can put the biological father's name on the birth certificate or even your maiden name if you're going to use it after the divorce.

you can name your baby anything you like, including your own maiden name if you didn't want to give it the father's name
