Is this harassment?Or what would you call it?
Or any form of it and if so what should be done? Okay my husbands mother and 4 year old niece are always being called racial names by there downstairs neighbors everytime the neighbor sees them racial slurs are always being said and there always picking on his 4year old niece calling her racial names everytime she plays outside this happends everyday..the mother of the 4year old niece went to the police station and tried to file a compliant and the officer said that he could not do anything and that was freedom of speech not harassment. What do u guys think?

Yes, it's harassment. And it's disgusting. But it's not illegal.
Your MIL needs to address this with her landlord. Check the local landlord/tenant code for "quite enjoyment" (or similar wording). With a child involved, in many jurisdictions, she could have grounds to break her lease, if nessecary.

It's harassment, not freedom of speech. The racial slurs constitute "hate speech", or "fighting words". This is not protected under the First Amendment. The Supreme Court in Arizona ruled that racial slurs against two African American women were not protected under the right to freedom of speech. Tell her to go back to the police, & insist that they take a report. Tell her to advise the police that if they refuse, she will contact the District Attorney's office. She should also report this to the landlord. She has the right to quiet use & enjoyment of her home, as does her niece. These people are disgusting bullies.

I personally do not think this is harassment, harassment for me is when someone is prevent you for doing something you like best. Example of which is when you want to play basketball in a court yard but someone is preventing you to do so by stopping you once you are inside the court yard. This is racist remarks, oftenly done by some members of the community that they feel these people are different either through their nationality or color of their skin. Calling them words is just fine just do not touch them or harm them that would be another part of a story. If the mother cannot get along with the people in the building I guess it is time for the mother to look for more suitable place to stay or live. With nicer people. Even if the mother tell the police the situation the police cannot arrest all the people in the building for saying bad or racist words to the mother. That would be illegal or unconstitutional. But if the people there touch or harm the mother and the nieces that would be criminal in nature and the mother can file a criminal offense against the people who done it. But that would make the situation in the building much worse than it is now. I suggest the mother find a new building to live with or just ignore the insult everyday.
