How to be in a special Ed class?
The reason I'm asking this is because I didn't pass the cahsee math portion. I been told that special Ed students don't need to pass it to graduate from high school. I have a couple friends that their in special Ed but their not mentally ill it's just they need extra help. My friends said they don't need the cahsee to pass. I can't ask them cuz they graduated over a year ago haven't talked to them since. So what do I tell my councilor that I need he'll to put me in a special Ed class ?

The IDEA law requires all states to evaluate all students to determine their eligibility for special education. It can't be a disagreement because it's a fact.
So after the evaluation has taken place, the educational professionals will determine whether that child is identified as having a disability as defined under the IDEA law.
After that, there will be a limited 30 days left before an IEP should be scheduled. This will always be an initial review. The IEP request will state which educators will be attending along with the parents and student (if appropriate). The IEP team together sets their goals for the student and determine the level of services that is needed for the child education. If the parent disagrees with their child receiving special education services of any kind, they have an option to not sign the consent. So if the parent agrees with the IEP, the parent must sign the consent as an agreement of their child's needs.
An IEP is always reviewed once every year. A parent has a right to schedule an IEP meeting anytime during the school year. But at the school district I volunteered at, they required another IEP meeting to be held during that current year if a student's IEP has been reviewed through a meeting before october.

Annie is wrong--you DO have to be tested and diagnosed with a disability of some sort to be put in special education. You say they're not mentally ill. Not EVERY special education student is "mentally ill" as you so eloquently put it. In fact, a very small fraction are "mentally ill." Generally, students on Individual Education Plans (IEPs) either have an intellectual disability or a learning disability. My guess is that your friends have learning disabilities.
You can't just join special education because you're failing a class and want to graduate. That's ludicrous, and quite frankly would be a waste of money and resources. Not to mention the fact that it would be immoral to be taking services away from people who really need it.
If I were you, I'd just deal with it and take the class over again. You're NOT going to convince your counselor to put you in special education. YOU were the one who failed and YOU are the one who needs to deal with the consequences.

I would talk to the school principle first to ask why your child is in Special Education classes. If the school does not have any legal justified educational reasons for what they are doing with your child, then you need to contact the School Board, and if needed, you could also contact an attorney. Make sure that you document everthing! Make sure that you keep copies of all documents between you and the school. By doing this you will be creating a documents "paper trail" that will back you up on your word, and if need be, you can refer back to the documents "paper trail" that you have created. You will be able to use the documents "paper trail" against the school if needed. But you should know that PWDs are demanding and getting full mainstream inclusion in today's mainstream society including within public school classrooms. Even though your daughter might be placed in a regular education classroom, it is very possible that there are PWDs in a regular education classroom with your daughter. I am a PWD by birth and I was mainstreamed into a regular education classroom throughout my public school career and I have meet other PWDs who were also mainstreamed into a regular education classroom thoughout their public school careers.

Your friends may not know it, but they are disabled if they are in special ed, most likely they have mild disabilities, for example Autism, Dyslexia, Dyscalculia, ADHD, etc. If you aren't passing due to lack of studying or work completion then you can't get in, however you may have Dyscalculia if you are switching numbers around or unable to understand math concepts

Special ed is something you have to be tested for, not something you can just ask for. It's not something you can join in just because you don't want to take a test. If you honestly think you'd qualify for special ed, have your parents talk to someone at your school about getting you tested.

If you are in the USA and are 14 or over you can ask for an Individualized Education Plan (IEP) to be written for you, and you get to sit in on every meeting.
Ohmystar...no, a student does not necessarily have to be tested and have a disability to be allowed an individual education plan.

Your parents need to sign something that allows you to be in special ed..thats what my teacher told me.Ask your parents and they will talk to the councilor.Well....thats if your parents approve of it.
