Child Custody and Leaving Country?

There is no set custody set in place with my child's father as of current. I am working on finding a lawyer to help out with the situation however I was just offered a job where I will be in Australia for six months and Canada for three. Can I legally take my child with me without risking being labeled that I abducted him? His father has only seen him once in fifteen months and doesn't pay child support. He won't cooperate with him with giving me his address of even phone number to file the paperwork needed for custody papers.

you said there was custody set in place, but you didn't say if there is a visitation order set in place. this is where you will get in trouble if you leave the country with out the fathers ok..

if there is not visitation order, then you shouldn't get in trouble for moving..

No visitation in place either. And technically I wouldn't be moving well for 6months I would be out of NV. Then come back here.

Given you will need the fathers signature on the child's visa application - he can decide then whether to let you go.

As long as u have a passport for u and the little one :) it shouldnt be illegal, or labeled as abducted.
