Netflix has arrangements with a select number of distributors. They get movies from Lionsgate, Paramount and MGM 8-12 months after theatrical release via the EPIX deal. They have have first run agreements with DreamWorks, the Weinstein Company and FilmDistrict. Netflix gets movies from those companies after their DVD exclusivity period ends. That generally lasts 90-120 days. They also have a first run agreement with Disney that takes full effect in 2016. All other major releases can take up to 10 years or more to reach Netflix. Some never will.

Some of the movies don't end up on Netflix. If they are really good like Harry Potter then I doubt they will ever be on Netflix. Sometimes the producers(I think) dont want to give Netflix the right to put it up because they will get less money out of it. But if it will be on Netflix then it will probably take months.
