Family trespassing on my land and threatening to sue me.?

I just bought a new home on a large amount of acreage. On the far side of the property from our home is about 80 acres uncleared wood (owned by me now) with an old run down cabin. We had a visit from some people down the road who stated to us that their teens love to come onto the land and use the cabin as a hang out. I explained that I was going to be Farming the cleared land and would most likely be hunting on the uncleared woods (Legal in this state before you go there.) When I said this she said "Oh no you cant have guns out there the kids hand out there. I told her that I planed on using the cabin and that they would be trespassing on private owned land and that to get the cabin they will be crossing my crops and possibly doing dmg. She informed me that they would sue me should they find out I had any guns or if I tried to keep the teens out of the woods or my cabin. I did tell her that I was sorry that the property was up for sale for about 3 years and they had grown used to using it free of charge but that I own it now. I plan to hang meat at this cabin and use a walk in smoke house that we are building. I also plan on having hunting buddies up here who are just so excited to hunt on 80 private acres (We have dear, turkey, and quail here) What is the best way to deal with this family before hunting season kicks in and we are out there with guns. I have posted no trespassing singes, and ordered the fencing we need for the fields but will not be able to fence off the woods. To get to the woods you have to use our land or walk around it and come in from the back side wish is all wooded land. These kids are going to cross my land instead of walking 3 miles out of their way.

You have the land posted. That gives you the right to have them arrested if they enter your land. If they cross your land and cause damage, you can also sue them (or their parents, if they are minors)

As a hunter you should know that YOU are responsible to ensure that your hunting is safe. If you believe that there are other people in the are, you should not be shooting.

That woman is not very smart about property rights, and you need to keep a lawyer ready and notify law enforcement about this before these other people "escalate" their annoyance.

One way out is to employ the kids in an age-appropriate way to do the work of clearing the land for crops and animal husbandry / livestock. If you make them part of the changes to the land, they might take "pride of ownership" of the work done and will respect the property boundaries, and will demand others also respect the property boundaries. Think of it as community involvement disguised as jobs for the children.

You are dealing with rural people who get habituated to doing what they want to do with little challenge from others, including neighbors, even when they are in the wrong. Stealing and poaching have always been problems in rural areas and is one strong reason a lot of people won't live in rural areas.

In Texas, for years I would drive from Lockhart to Cuero on US Highway 183 and see many abandoned houses in the countryside, some near the highway, some far away. There were no jobs and farming and ranching were difficult due to lack of adequate inexpensive water.

But since 2008 the oil business has increased the amount of drilling and fracking in that area and all of those old houses have been repaired, renovated, and occupied by the crews working in the area. This isn't forested land so woods only appear around creeks and rivers, and drought over the area for the last three years probably discourages higher population densities. But I have heard thefts and burglaries have increased in the area.

You've posted signs, you've warned their parents, short of arresting one that is about it.

I suggest that you secure the cabin, making it more difficult to "hang out" in. A couple of new locks won't actually deter them, but it covers any claim that you're maintaining an attractive nuisance. A busted lock will even let you go on record with a police complaint.

She can't sue you, she's just stupid. There is no reason that you should be required to allow the local kids to have a drinking and smoking spot. Like a lot of people who buy a house in the country, usually a corner lot on a street, they seem to think this entitles them to some sort of usage of the neighbor's property.

And one thing you don't want to do is buy a few paintball guns, get liquored up and hunt them like animals. Sure it's hilarious, but apparently it's also assault.

"The Trespassers Will Be Shot" sign ought to be pretty self explanatory. "Looks" threatening and IS Threatening are two different things. If someone "looks" like a threat, I'd tell them to get off my property before the cops get here. If someone threatens me or my children on my land or in my home, you can be GD sure they'll be leaving with an extra orifice. WHY?? Because I love my family more than I'm afraid to hurt a threatening stranger.

I may be wrong, but I don't think someone else can sue you for what you do with/on your own property.

In fact, for insurance purposes they should keep off the land, I would think. Make sure you have a lawyer looking out for your interests.

Is your land posted? Post PRIVATE PROPERTY - TRESPASSERS WILL BE PROSECUTED signs around your perimeter.

Then they don't have a case that I can see. I have training in legal research but I'm NOT a lawyer.

Check your state laws to be sure.

i would fence off what i could and post signs, post it in the news paper in your town also that he land is posted no trespassing. if there is a way to put a little current on the fence i would do that also, that way if they try to climb over they get little tickle

everytime they are there, have them arrested. In my state I can post the land then shoot the buggers after a single warning.
