Are computer manufacturers allowed to advertise the overclocked speed of the processor?

I recently bought a computer that advertised a 3.8 ghz processor speed, but it was actually only 2.8 ghz. Is 3.8 the maximum overclocked speed?

    It is the turbo speed of the processor.

    Technically that OEM is cheating like that as it can only hit 3.8GHz under many conditions,like how many cores are utilized,how much heat needs to be dissipated etc.

    Well they should have mentioned it was either the "turbo" mode, or if it was truly an OC - if it is a gaming computer (alienware, falcon northwest, digital storm) then its an OC.

    If you are positive its not because you messed with the BIOS, and you're positive they never mentioned that 3.8 was an OC, or never mentioned 2.8 was the normal speed, then you can get on to them about misrepresentation but it wont go anywhere - unless you just bought it and tell them you want to return it to see what they'll do (maybe reimburse a small amount) - If it was from a large, well known manufacturer then I'd say you might have misread - they aren't going to try and defraud someone and risk getting in trouble over something so trivial.
