now that weed is legal for recreational use, how will that effect drug testing in those states?
now since there is no test that exists to tell "when" you last smoked only that it was "sometime" in the last month or so, how is it fair for you to be terminated for what is now a legal activity when the very test used as the basis to fire you cannot show you broke any company rule or policy at work and there is no proof you used it anytime other then on your own free time away from work in full compliance with the law?
before you are too quick to jump in with the standard pat answers you need to stop and think about this now, this question pertains to states where weed is legal and no different then alcohol or beer.
since a urine test can only show you had smoked "sometyime" in the past 30 days then how can that be a fair and reasonable test to determine if you were smoking on the job or working under the influence while at work?
if you think that the urine test being used today should still be in use simply because there is nothing better or mare accurate to replace it with, then how would that be any different then if you failed that same test because it showed you were drinking a beer "sometime" in the last 30 days and by your claim that its a justified standard that would also mean you would have to agree drinking a beer "sometime" in the past 30 days to also be a perfectly justifiable cause for termination as well.
they are perfect examples of the same scenario, both are legal substances you are free to partake of on your own time but not allowed on the job or to be under the influence of while at work.
no one has yet addressed the question asked, how will legalized recreation weed use effect drug testing methods that do not identify when you use or are under the influence of drugs

There is a company in Illinois that banned tobacco. They drug test for nicotine and fire those who test positive. Companies can make rules and require their employees to follow them or be fired. I refuse to work for anybody who drug tests. If everybody would vote with their feet on such policies they wouldn't exist.

Most companies have a zero tolerance if they do drug testing. When, how long ago is not an issue. You walk in the door, test dirty..and you do not get hired. Consequently, you test dirty..bye bye. This is not difficult to understand even for someone who does not know how to use "effect" and "affect".

It's still illegal under federal law. And even if it were not, employers could choose not to employ anyone who consumes marijuana. Just like they could choose not to employ anyone who plays pool, or drives a BMW.
Also, please learn the difference between "affect" and "effect."

You can smoke all you want. They can choose not to hire you if they want.
