her accident and geico?

My spouse was involved in a little fender bender. She wanted to change lanes and slowed down for too many cars in the way and another woman came around quickly and dented her left front fender. The other woman admitted guilt and recieved a ticket. My spouse recieved no ticket. I could tell by the damage to her car another car made contact. My insurer geico tells me the other woman recanted her story and her insurance wont recognize the accident. After paying the deductable $500, geico tells me a third party must be used to get the other insurance company to accept the at fault and pay up. And geico has been telling me this for 2-3 months. What is your opinion please?

    More info is needed to provide an accurate answer: In what state did the accident occur? Is the other person uninsured? Were there any witnesses?

    It sounds like the police arrived and wrote a report, which is a positve. Not knowing who insures the other driver or if they are insured at all, it is difficult to know exactly what is happening.

    From my experience, it sounds like the other company has denied liability or coverage.

    If they denied liability and are members of Inter-Company Arbitration, GEICO may have filed against them so that an arbitration panel can review the evidence and make a ruling. This process often takes several months, but could result in the other company being forced to pay your claim if the panel decides in your favor.

    If there is insurance but the company is not a member of arbitration, GEICO would have to decide whether it's feasible to incur the cost of litigation.

    If there is no insurance, the other party also likely does not have any assets which would justify the cost of litigation. In such cases, the matter is usually referred toa collection agency and they forward a percentage of whatever they may recover.

    Geico seems quick to pay out to other person and not be on insureds side in my experience and they are just as quick to drastically raise your rates to recoup their money.
