My headlights come on when i start my car?

I recently bought a new car. My headlights controls with say they car off but are still on when i turn on my car. But they do go off when i turn off the car. Now my car battery light on. So my battery is dead. I cant even start my car to even take it back. LIke what should i do? I know to call the guy, which i most certainly will be doing?

BTW i have an 08 Suzuki Forenza

Update:

But my headlight weren't on at all. They were off. Even the light inside my car was off.

    5 years can be the expected life of a battery. Is it the battery the cat left the factory with?

    If the lights are only on when the engine is running, then that may well be a feature of the car - many new cars have Daytime Running Lights, and in many countries they are now compulsory.

    The lights being on when the car is running won't make your battery go flat - however if they were on when the car is not running it would do.

    You most likely have daytime running lights. Supposedly, the lights on during the day increase safety. It's not a problem at all. You won't run down your battery or anything. It could be the switch to set them off could be broken, or it could be you don't have them off, but in a sensor mode, and the sensor that detects whether they should be on is broken.

    those light are driving lights, not the headlights ! on a lot of newer cars as soon as you start it the driving light comes on ! nothing to worry about, it,s just the way it was built !
