Refused job because I am 18?, Took a gap year. Help?

Hey Yahoo,

Basically I have been talking with the owner of a local chain of shops near me (Nothing massive but quite a few of them). I originally applied for a job and they said that I could have one and they would get back to me, Time went on and I was planning on going to university, I got back to her and said "Can I still have a job", She said I would have to take a Gap year as she was not looking to hire someone for a few months, I have now taken a Gap year, With the intention of working, and went into the store today and said "I've taken a Gap year" and she replied "You're friends are 17 aren't they", I said I have no 17 year old friends, All my friends are on their way to University", She then said "They smoke don't they" and I told her that none of my friends smoke as far as I am aware", She then told me she was unsure that she could hire me because she thought that I would sell them cigarettes, I said that I wouldn't, I had no 17 year old friends and I having studied Law for 2 years understand the consequences of doing so, she carried on saying the same stuff, Normally I wouldn't mind but she had assured me If I took a gap year then I would have a job, she also keeps saying "I will think about it" and never gets back to me. Right now she is going to "Think about it over the weekend", I have to stress I have been as polite as I possibly can be and made a effort not to pester her. I am wondering, Is it fair to not employ someone for an action that haven't committed

    Fair and legal are not always the same thing. The shop owner doesn't seem to have done anything illegal.

    Life isn't fair - and to take a gap year simply because a possible employer tells you she isn't hiring now, and expect to have a job with her after your gap year without having a contract in place guaranteeing such a job, is ludicrous.

    Move on.

    I think she is just making excuses not to hire you. She was probably hoping that you would find another job in your year off. My advice is to look for a job elsewhere.

    She doesn't want to hire you , go up there and tell her to be an adult and tell the truth rather then ***** footing around.

    Get a job at a factory.
