Should I get a lawyer?

I was in an car crash on Friday that was not my fault. Driver was cited for felony DUI, felony hit and run, suspended license, no registration, no insurance, and the list goes on! I was transported to the hospital via ambulance. I have abdominal bruising and neck/back injuries. I'm following up with my primary later today. My kids were seen in the ER, but my husband followed us in his car. They have mild neck soreness and seat belt bruising, but I don't think they need to be seen by a doctor. They should self heal. My car is totaled. I have uninsured motorist insurance. Should I get a lawyer or wait a little bit to see how my insurance company handles the situation? I don't want to suffer so some stupid lawyer can get more money than me. Thanks!

    You can get a lawyer but yeah, they'll take a third of whatever you're awarded.

    I think you're better off giving your insurance company a chance to represent you.

    You should get an attorney to help you. An attorney who is skilled in both Personal Injury and Criminal law can actually help you get restitution from the criminal clerk. Even any fees paid to the attorney for his services are recoverable in criminal restitution.

    However, pick your attorney carefully. Most civil/personally injury attorneys have NO experience in criminal court and don't know how to obtain such a resolution in your case. Mind you, this goes above and beyond just obtaining the policy limits for insurance.

    In addition, your attorney knows how to negotiate the medical bills. Typically, I get 50-60% reduction on my typical client's medical bills and my client pocket's the savings. I even have my own reduction clerk to make sure this gets handled properly, so, in this case, yes, I think you should hire an attorney.

    Lawyer, because it should be the other driver's insurance that pays for everything.
