My homeowners assoc. wants to hit me with a bill. What do I do?
I reported a problem with my bathtub. Plumbers came out, looked at the problem and told me it was not my fault. It had to do with work done on the adjacent apartment. That apt. has turned over twice recently and it is impossible to pinpoint blame. Once informed, our President offered 1500 dollars to replace the bathtub and fix the wiring. Ten days later, the President sends me an email to pay up. All or part, I don't know. Advice please, and thanks! P.S. I own my condo outright.
I have not signed anything. The President, she says its nothing personal, its just that I have to pay my fair share.
In addition, I have several emails from the assoc. Pres, allocating a sum of 1500 dollars for repairs, without mentioning the expectation of repayment. Had I known, I might have sought cheaper options.

Just don't pay it. If they take you to court, go to court and explain it to the judge and let him decide who pays what. If they take you to collections but not court you can always pay a small amount (like $50) and then take them to court to get your $50 back, and again the judge will decide if you owe anything (when you send them the money include a letter saying you don't owe them this money and will be suing them for it but are paying it to save your credit).

I would go over the contract I had signed with the HOA and see what it says regarding repairs. I would also get what your plumber said about it being your neighbors fault in writing. You can never be too careful. What reason did he give for his decision to now bill you? Did he give you any paperwork or a contract when he originally paid for the repairs? It sounds fishy to me. Maybe you should bring it up at the next HOA meeting. If nothing else you might get to the bottom of this.

You pay because it is still your property. It is not the HOA's property. After that you sue the party you think should be paying. It would never be the HOA though, they are third party. It does not matter who rents the place, if the other unit is as fault then whoever owns that unit is who you pursue. The HOA can not pursue them, as they are not involved.

Contact the President and discuss this with them, if they offered a replacement due to the neighboring condo, I would not expect to have to pay them back for it.

You should have had the plumber put in writing that the problem was not your fault.
Can you contact the plumber now and get a written statement from him?
