Blackberry password lock?

I recently bought a blackberry mobile from Ebay, it arrived friday with no battery life.

I charged it up all day and when I turnt it on, its come up with a password that I need to enter, and the name of Emma **** in the top left corner.

I contacted the seller and explained the situation, he saod it was his sisters and she cant remember the code. It makes me think its a stolen blackberry that I've purchased? I purchssed it and it stated that it were fully working and unlocked. The photos showed a blsckberry on a working menu.

I've contacted ebay to let them know of the situation but now I'm stuck with a locked BlackBerry.

Is there anyway I csn get into the phone? Someone said you can enter the password wrong 10 times and it wipes all info and factory resets..... does this mean it woukd then be unlocked?

Not really sure what to do to be honest..

    Well what you should do is contact the seller again say what kind of Product have you gave me.then if the seller don't do Anything about then depending on how many days it has been return it explain your reason why and then problem solves btw dnt click refund beacuz it will cost

    enter the wrong password ten times and the phone will do a security wipe. all the persons data will be gone.
