How Should I Go About Fighting This Ticket?

A cop pulled me over late last night and cited me for "Unsafe Start From Stopped"

My friends were all sitting around me in traffic, by luck. My best friend was next to me, my other best friend and his girlfriend was behind me, my girlfriend was behind them, and the cop was either behind her or behind the car behind her.

"Unsafe" is REALLY ambiguous, and I want to fight this. I maintain that I didn't do anything unsafe. I did accelerate quicker than my friends, and I let my RPM's build so it made a fair bit of noise, but I did nothing unsafe.

Will having 3 or 4 witnesses help me?

What else do I need to do?

Thanks!

Unsafe is a judgement call. If your witnesses have more experience in road safety than the police officer, you might can fight it.

No your witnesses will most likely not help you.

The officer who stopped, witnessed you accelerate hard and this situation fits the statue or ordinance of the city or county you live in; you will be found guilty simply because the officer witnessed it and it fits the parameters of that said statute or law.

This is not a judgment call made by your friend's despite how they feel it went down. It was a traffic stop by a uniformed police officer, not a child or a minor, but and officer of the law. 99% of the time the courts will side with the officer, no joke

As you can imagine the first thing that you must do to fight a ticket is to read the actual law you are accused of violating. It's almost funny to watch someone get humiliated in court by the police officer when they never even bothered to read the law for them self.

In my state, even the smallest amount of wheel spin (peeling out) would be enough for a conviction. In my state - because it is in the same category as street racing, your license will be suspended for a year if you lose. Your state may be different.

You are at a true disadvantage in court. The officer is smarter and better trained than you. The officer has been to court hundreds of times and you have not. The officer has investigated hundreds of traffic crashes - so he knows what type of driving decisions cause crashes.

Your witnesses will be utterly and totally useless in court. Your witnesses have no training in the law, no experience in investigating traffic crashes and probably won't even know how to properly testify in court.

If you fight this in court and lose you will be required to pay court costs that may cost more than the ticket. Why not see if you can apply in advance to go to a driver improvement program? Many courts allow this for your first ticket. Most importantly it may keep the ticket of your record. A traffic conviction leads to higher insurance rates.

    Hope this helps.
