How can I make sure a used phone is not stolen?

Update:

I noticed that there's a lot of used phones on Ebay and in local classifieds. Telling me to try and activate it isn't terribly helpful. That's kind of what I'm concerned about, because at that point, there's really nothing to be done. If the phone shows as stolen, the provider will take the phone, and I'll be out the money. What I'm asking is whether there's some way to check BEFORE buying it.

    Call in the serial number to the carrier it's from.

    The only way you can find this out is by taking it into the Carrier where the phone is from and when they try and activate it and it will come up stolen and that is IF the person who the phone was stolen phone knows the serial number and was able to give it to Police when it was stolen.

    If you have any inkling the phone is stolen don't accept it or buy it because if you are busted with it and it is indeed stolen you could be arrested and charged with Receiving Stolen Property.

    Usually when you take a phone in to get activated they'll know if the phone was stolen or not... and then confiscated. That is if someone has reported it. Of course if it has a sim card there really is no way to tell.
