Neo nazi controversy ..law assignment help?

So for my law class, we have to be lawyers and defend our side. The case is neo nazis asking for permission to protest against the jews in toronto. They hate the jews, blame everything on them and want them out of this country. I'm against the nazis so i have to deliver a 3 min speech on my side and at the end the audience votes on who wins. Anyways so i just dont know how to start..i mean i want to bribe people emotionally and use real facts and incidents and the charter of rights as well.. If anyone could give me better points to win this against the neo nazis, since they have the freedom to assemble according to the charter which makes it harder for me to win it!

    Your side sucks to defend. If you can find examples of calls to violent action, you can argue that what Neo-Nazis are engaged in is incitement to violence, and not protected hate speech. It's a weak case, and you probably won't get away with it. You might also try pointing out that they are maligning a group of people for the express purpose of causing that group harm. Slander and libel protect individuals when people do the same against an individual or a company, so why can't a religion or an ethnicity enjoy a similar freedom from slander and libel? You can even point out that the intent to cause harm to the group in question is readily conceded by the Neo-Nazis. If I were to do the exact same thing to McDonalds, or a family down the street, or the staff of a private school, I'd be taken to pieces in court.

    Again, weak arguments, but as you pointed out, you have the harder of the two positions to defend. Sorry I can't be more helpful. I'm also ignorant of Canadian law. Hell, I'm ignorant of US law, for that matter.

    It is called the "freedom of association." If the government can restrict who you associate with, no matter how despicable they are, that government can control who your friends are.

    Let's face it, just about everyone has some idea they like that others find "kooky", does the government have the right to become the "thought police?"

    If we are to be free, then people that only want to be around their race should be free to do so, no matter how intolerant it may sound.

    It is when they infringed on others rights to freedom and property that government must enforce the protections under law and civility.

    Eventually, bad ideas fade away with time, but freedom will never fade. This is the cost of that freedom, to allow racists, religious zealots, political affiliations, alien believers, etc., to exist in a society is tolerance.

    Neo Nazis arguments are very simple but they conceal it in a web of intrigue and suspense. Just lay it out straight. Nazis believe a bunch of nasty evil doers called the Jews are plotting to take over institutions and mess with the minds of white Ayran men. The real issue here is that by allowing them to protest you are validating their belief that Jews are evil. The other thing is that in most cases people will ignore trouble makers as long as they keep their hands off them. When Neo Nazis get up to talk unlike conservatives or libertarians they push the envelope too far to the point of literally coming out with things that are designed to hurt people emotionally. Many conservatives and a fair few communists say things that are deeply shocking but in the case of Neo Nazis they throw everything in ceremonies and rituals in order to impress the population not with deeds but with fantasy. Most Neo Nazis don't want freedom, they want to round up people and beat the crap out of them so most just want an excuse to express themselves in physical form. The best way to test a warriors strength is to fight people on the street. These events offer them a great chance to show their prowess and physical endurance.

    1) I would question the legitimacy of using the term "neo-nazi". The term "Nazi" refers ONLY to German fascists and not to all fascist around the world. The USTASHI were the Croatian Fascists while there were the Italian Fascists, the Spanish Fascists, Estonian, Lithuanian, Ukrainian, Argentinian, Turkish and even Greek (both during WW-2 and later during the "Rule of the Colonels") Even the US had several fascist organisations prior to WW-2 including the "German-American Bund", the "Friends of New Germany", the "Silver Legion of America" and the "Free Society of Teutonia". Even the Klu Klux Klan had, and still has, fascist ideologies.

    2) .All fascist ideologies are based on violence and the idea of "promoting violence and race hatred". The whole premise of fascism is the domination of the many by a small number of people supported by a capitalist economy. It is a politically and economically undemocratic society.

    Racism is like cancer and death, can't be cured but always fought against, they manipulate every reason use any means to destroy humanity, don't let the race-based criminals and thugs take power lest it be like Greece now (see the case of Golden Dawn's party/neo-nazi)
