Could you press charges if...? (abortion)?

So, in most states, if someone other than the mother terminates the pregnancy in say a car crash, they can be charged with homicide. However, could they still press charges if the mother was on her way to an abortion clinic? I mean, it might be manslaughter for someone else, but if its your own child than its ok right?

Would the mother still be able to press charges if the baby died and she was on her way to an abortion clinic?

    In the majority of states, the legal time frame for an abortion does not overlap with the time frame for double homicide if the fetus is killed by someone else.

    You can't be charged for killing the fetus if you do it before week 21 in most states and you can't have an abortion after 21 weeks in most states (there are some states that have varying laws and some abortions are allowed for medical reasons).

    So no she couldn't "press charges" (not up to the mother anyway, that's the DA's job) because if she was on her way to get an abortion, the law wouldn't cover the loss of the fetus.

    First, the driver would have to have been driving recklessly. But even if that were the case, since the fetus was nonviable (unless the mother was on her way to have an illegal abortion of a viable fetus), the driver could not be charged with homicide.
